Terms of Use

These terms are the agreement between your business and us for using Tendly. We've written them to be read. If anything is unclear, ask us.

1. Who we are

Tendly is a product of Syntiva Technology LTD, a company registered in the Republic of Cyprus (registration HE 482247), at Christodoulou Sozou 2, Eiffel Tower, 2nd floor, Office 201, 1096 Nicosia, Cyprus ("Tendly", "we", "us").

"You" means the business that uses Tendly, and the person accepting these terms on its behalf. By starting a preview, subscribing, or using any part of Tendly, you confirm you own or manage the business and can agree to these terms for it.

2. What Tendly does

Tendly builds and runs a website for your business, with online ordering or booking requests, an owner dashboard, and an AI receptionist that answers your business's phone line. We host it, keep it running, and make reasonable changes you ask for, such as updating your menu, prices, photos or hours.

We build your first version from public information about your business, such as your Google listing, reviews and existing website. Please check it: you're responsible for what your site says once you subscribe.

3. Free preview

  • A preview is free for 14 days (or longer if we say so) and needs no card.
  • A preview may carry a banner saying it isn't your official website yet, and its receptionist has a limited number of demo minutes.
  • If you don't subscribe, the preview and its phone number are switched off at the end of the preview. Nothing is charged.
  • Test orders and bookings on a preview are not real sales and don't move money.

4. Your account

Your dashboard link is private. Keep it safe, as anyone with it can see your orders, bookings and messages. If you think someone else has it, contact us and we'll issue a new one. Keep the email address on your account up to date so you receive notices from us.

5. Plans and billing

  • You choose a plan when you subscribe. Current plans and prices are shown on our pricing section and at checkout.
  • Plans are billed in advance, monthly or yearly, in US dollars, by card through Stripe. Yearly billing is charged at ten months' price for twelve months of service.
  • There's no setup fee. Prices exclude any sales tax or similar taxes that apply to you, which we'll add where required.
  • Founding price. If you subscribed at a founding price, that price stays the same for as long as your subscription continues without a break. If you cancel and later return, current prices apply.
  • We may change other prices with at least 30 days' notice by email. The new price applies from your next billing period after the notice ends, and you can cancel before then.
  • If a payment fails, we'll let you know and retry. If it still hasn't been paid after 14 days, we may pause your site and receptionist until it is.

6. Receptionist minutes

  • Each plan includes a number of receptionist minutes per calendar month. Unused minutes don't carry over.
  • You can buy extra minute packs from your dashboard. They're added to the month you buy them in and don't carry over either.
  • When a month's minutes are used up, calls go to the transfer number you've set, or callers are given your main number, until the next month or until you add minutes. We'll email you as you approach the limit.

7. Cancelling and refunds

  • You can cancel anytime by contacting us. Cancelling stops the next payment; your service continues until the end of the period you've paid for.
  • We don't refund partial months, unused minutes, or the remaining months of a yearly plan, except where the law requires it.
  • When your service ends, your site, receptionist and phone number are switched off. Ask us before then and we'll send you a copy of your content (text, menu or service list, and photos you gave us).

8. Payments from your customers

  • Card payments from your customers go to your own Stripe account, which you connect from your dashboard. You're the seller of record for those sales and deal with your customers, refunds and chargebacks.
  • Your Stripe account is governed by Stripe's own terms, and Stripe charges its standard processing fees. We take no commission on your sales.
  • Until you connect Stripe, customers pay you in person at pickup or on delivery.

9. The AI receptionist

  • The receptionist is a computer program. It tells callers it's a virtual assistant and that calls are transcribed so your team can follow up. You agree to this disclosure and won't ask us to remove it.
  • It answers from the information on your site and in your dashboard, and it can make mistakes. Orders, bookings and messages it takes appear in your dashboard for you to confirm. Check them, especially prices, times and addresses.
  • It is not for emergencies. It tells callers describing an emergency to hang up and call 911.
  • We keep call transcripts and summaries so you can see them in your dashboard. See our privacy notice for how long we keep them.
  • Tendly is not designed for health or medical information. Don't use it to take or store patients' health records.

10. Your content

Your business name, logo, photos, menu, prices and other material you give us or that we use with your approval stay yours. You give us permission to use, copy, adapt and display that material to build and run your site and receptionist for as long as you use Tendly. You confirm you have the right to let us use it, and that it's accurate and lawful.

11. Acceptable use

Don't use Tendly to sell anything illegal, mislead customers, infringe someone else's rights, send spam, collect data you're not allowed to collect, or interfere with the service or other businesses using it. We may remove content or pause a site that breaks these rules, and will tell you why.

12. Domains

If you connect your own domain, you keep ownership of it and stay responsible for renewing it with your registrar. When your service ends, point the domain elsewhere; we'll stop serving your site on it.

13. Other services we use

Tendly runs on trusted providers, including Cloudflare (hosting), Stripe (payments), Twilio (phone numbers and calls), OpenAI (the AI that powers the receptionist and helps write your site), Google (business listings) and Resend (email). Their outages or changes can affect Tendly. We choose them carefully but can't control them.

14. What stays ours

The Tendly software, designs, templates, dashboard and receptionist, and everything we create that isn't your content, belong to us. While you're subscribed, you may use them for your business. Phone numbers we provide are ours to assign; when your service ends, the number is released.

15. Changes and availability

We work to keep Tendly available around the clock, but can't promise it will never be interrupted, for example during maintenance or a provider outage. We may improve or change features. If we make a change that meaningfully reduces what your plan includes, we'll tell you in advance and you can cancel.

We may update these terms. For significant changes we'll email you at least 30 days before they take effect. Continuing to use Tendly after that means you accept the new terms.

16. Warranties and liability

Tendly is provided "as is" and "as available". To the fullest extent the law allows, we don't give warranties that it will be error-free or meet every need, and we're not responsible for lost profits, lost sales or indirect losses, including from a missed call, an incorrect order taken by the receptionist, or an outage.

Our total liability to you for anything related to Tendly is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

You'll cover us for claims from third parties caused by your content, your products or services, or your breach of these terms.

17. Ending the agreement

You can end this agreement by cancelling. We can end it with 30 days' notice, or immediately if you seriously or repeatedly break these terms or don't pay. If we end it without cause, we'll refund any amount you've paid for service after the end date.

18. Law and disputes

These terms are governed by the laws of the Republic of Cyprus. Before starting any formal dispute, please contact us so we can try to fix it. Any dispute that can't be resolved goes to the courts of Cyprus, unless the law where your business is based gives you the right to bring it there.
